These Terms and Conditions (“Terms”) govern your access to and use of the BandVagon mobile application (“App”), operated by BandVagon (“we”, “us”, or “our”). By downloading, accessing, or using the App, you (“User”, “you”) agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Definitions
- “App” means the BandVagon mobile application, which enables users to order groceries and daily essentials.
- “Services” means quick-commerce grocery and daily-essential delivery services provided through the App.
- “User” means any individual or entity using the App.
- “Order” means a request placed by the User through the App for purchase and delivery of products.
2. Eligibility
- You must be at least 18 years of age to use the App.
- By using the App, you represent that you are legally competent to enter into a binding contract under Indian law.
3. User Account & Responsibilities
- You must provide accurate, complete, and up-to-date information while creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are solely responsible for all activities carried out through your account.
- BandVagon shall not be liable for unauthorized access resulting from your failure to secure your account.
4. Services Availability
- Our Services are available only in select locations, which may change from time to time.
- We reserve the right to modify, suspend, or discontinue any part of the Services without prior notice.
- Product availability may vary based on location, time, and stock.
5. Orders
- Orders can be placed only through the App.
- All Orders are subject to acceptance and availability.
- We reserve the right to reject or cancel any Order at our discretion, including due to unavailability, pricing errors, or suspected misuse.
- Images displayed are for illustrative purposes only; actual products may vary slightly.
6. Pricing & Payment
- Product prices and delivery charges are displayed at checkout.
- Prices may change without prior notice.
- Payments can be made via credit/debit cards, UPI, wallets, net banking, or Cash on Delivery (COD).
- Failed or incomplete payments may result in automatic Order cancellation.
7. Delivery
- Delivery timelines provided are estimated and may vary due to traffic, weather, operational issues, or force majeure events.
- Delivery may be carried out by third-party delivery partners.
- If the User is unavailable at the delivery address, the Order may be cancelled without refund.
- Delivery charges may vary based on location, order value, and delivery speed.
8. Returns, Refunds & Replacements
- Our Return and Refund Policy is provided separately and forms an integral part of these Terms.
- Certain items such as fresh produce, dairy, frozen goods, and perishables may not be eligible for return.
- Refunds, if approved, will be processed within 5–7 working days to the original payment method.
- BandVagon reserves the right to deny refunds in case of misuse or false claims.
9. Abuse, Fraud & Account Suspension
- Users must not misuse offers, promotions, refunds, or COD facilities.
- Any User found engaging in fraudulent activity, repeated false complaints, excessive refund requests, COD refusals, or abusive behavior may have their account suspended or permanently blocked without notice.
- BandVagon’s decision in such matters shall be final.
10. User Conduct
You agree not to:
- Provide false information
- Harass or abuse delivery personnel or customer support
- Use the App for unlawful or commercial resale purposes
- Interfere with the App’s security or functionality
11. Product Quality & Disclaimer
- Products are sourced from third-party suppliers.
- Minor variations in weight, packaging, or brand may occur.
- BandVagon does not manufacture products and is not responsible for manufacturer defects beyond applicable laws.
12. Privacy & Data Protection
- Your personal data is collected and processed in accordance with our Privacy Policy.
- By using the App, you consent to such data collection and usage.
- We comply with applicable Indian data protection laws, including the IT Act, 2000 and DPDP Act, 2023.
13. Intellectual Property
- All content, logos, designs, text, and software are the exclusive property of BandVagon.
- Unauthorized reproduction, distribution, or modification is strictly prohibited.
14. Limitation of Liability
- BandVagon shall not be liable for indirect, incidental, or consequential damages.
- Our maximum liability, if any, shall be limited to the value of the Order placed by the User.
15. Force Majeure
BandVagon shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to natural disasters, strikes, government restrictions, internet outages, or pandemics.
16. Termination
- We may suspend or terminate your account at any time for violation of these Terms.
- You may terminate your account by discontinuing use of the App.
17. Amendments
- BandVagon reserves the right to update or modify these Terms at any time.
- Continued use of the App constitutes acceptance of the updated Terms.
18. Governing Law & Dispute Resolution
- These Terms shall be governed by the laws of India.
- Any dispute shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
- The seat and venue of arbitration shall be India.
